The Present: Panic Attack Support mobile application (hereinafter: "App") is run by Present Labs Ltd, Identification number 517124392, located at 13 Zlatopolski St, Tel Aviv, Israel (hereinafter: "The Company").

These Terms & Conditions (these “Terms”) contain the terms and conditions on which we supply content, products, or services listed on the App, or via other delivery methods (collectively referred to as the “Services”). We reserve the right to update these Terms at any time at its sole discretion.

Please read these Terms carefully before using the Services, whether accessed via the Website, third-party app stores (e.g., the Apple App Store, Google Play Store), or any other platform. The terms “us,” or “we” refer to The Company and any of its affiliates. The term “Device” refers to any device used to access the Services, including but not limited to computers, smartphones, and tablets. The term “you” refers to the user of the Services.

By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must discontinue use of the Services immediately.

2. HEALTH DISCLAIMER AND IMPORTANT MEDICAL WARNING

The App is designed to assist users in managing anxiety attacks by providing practical tools such as deep breathing exercises, grounding techniques, and similar coping mechanisms. However, IT IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. Always seek the advice of your physician or other qualified healthcare providers with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read or heard within the App.

IMPORTANT MEDICAL WARNING: The symptoms of an anxiety attack (such as chest pain, shortness of breath, rapid heartbeat, dizziness) may resemble those of a heart attack or other serious medical conditions. If you are experiencing severe symptoms, are unsure about the nature of your symptoms, have pre-existing medical conditions, or if your symptoms persist or worsen, SEEK IMMEDIATE MEDICAL ATTENTION. Do not rely solely on the App to determine whether your symptoms require medical intervention.

3.  NO MEDICAL OR MENTAL HEALTH SERVICES

The App does not provide medical, psychological, or therapeutic services. The content, exercises, and guidance within the app are for informational and educational purposes only. They are not intended to diagnose, treat, cure, or prevent any disease, mental health condition, or medical disorder.

The tools and techniques provided in the App are meant to supplement, not replace, professional care. The effectiveness of these tools may vary from person to person, and we make no guarantees regarding their efficacy for your specific situation.

If you believe you are experiencing a medical emergency or mental health crisis, call emergency services or seek immediate medical attention. If you are under the care of a healthcare provider for anxiety, panic attacks, or any other condition, consult with them before using the App to ensure it is appropriate for your needs.

4.   You will not misuse, exploit, or attempt to abuse the Services, including engaging in any activities that disrupt or harm the App's functionality.

5.     You will consult with a qualified healthcare professional before making any changes to your health regimen or if you have any concerns regarding your well-being.

6.     If you experience any adverse effects or worsening of symptoms while using the App, you will discontinue use and seek professional medical advice.

7.     You understand that the App is designed as a supportive tool only and not as a primary treatment method for anxiety or panic disorders

6. USAGE RESTRICTIONS

You agree not to:

1.  Use the App for any illegal purposes or purposes prohibited by these Terms.

2. Distribute viruses or other malicious code.

3. Attempt to hack, breach, or compromise the security of the App.

4.    Use the App in any manner that could damage, disable, overburden, or impair the App

7. DISCLAIMER OF WARRANTIES

The App is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not guarantee that:

1. The App will meet your specific requirements.

2. The App will be uninterrupted, timely, secure, or error-free.

3. The results from using the App will be accurate, reliable, or beneficial to your well-being

4.     The tools provided will be effective in managing your specific symptoms or condition.

5. The App will correctly distinguish between anxiety symptoms and symptoms of other medical conditions.

We make no representations or warranties of any kind regarding the accuracy, reliability, or effectiveness of the Services. Your use of the Services is at your own risk.

8. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, the App, its affiliates, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages. The App is provided on an “as is” and “as available” basis, and we make no guarantees regarding accuracy, effectiveness, or suitability for individual users.

9. TERMINATION OF ACCESS

We reserve the right, in our sole discretion, to suspend, restrict, or terminate your access to the App at any time, for any reason, including but not limited to:

1. Violation of these Terms

2. Abusive or fraudulent behavior

3. Any conduct that we believe harms other users, disrupts our Services, or exposes us to legal risk

10.  UPDATES AND MODIFICATIONS TO THE APP

We reserve the right to modify, update, or discontinue the App or any features, functionalities, or content of the App at any time, with or without notice. We may also impose limits on certain features or restrict your access to parts or all of the App without notice or liability.

Updates to the App may be issued from time to time through your app store. Depending on the update, you may not be able to use the Services until you have downloaded the latest version of the App and accepted any new terms.

11. USE OF THE APP BY MINORS 

You must be 18 years of age, or the age of majority in your province, territory, or country, to sign up as a registered user of the Services. Individuals under the age of 18, or the applicable age of majority, may use the Services only with the involvement and consent of a parent or legal guardian, under such person’s account and subject to these Terms. The parent or legal guardian is responsible for ensuring that the minor user complies with these Terms and assumes all responsibility for their use of the Services.

12. GOVERNING LAW & JURISDICTION

These Terms shall be governed by and interpreted in accordance with the laws of Israel, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts of Tel Aviv-Jaffa, Israel.

13. INDEMNIFICATION

You agree to indemnify and hold harmless the Company, its directors, officers, employees, and agents from any claims, demands, losses, liabilities, and expenses (including attorneys’ fees) arising out of or in connection with: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any rights of a third party.

14. INTELLECTUAL PROPERTY

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are the exclusive property of the App or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

15. SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.
